CONDITIONS GÉNÉRALES DE VENTE

1. Généralités
Les présentes conditions générales de vente (CGV) sont conclues entre :
Lila Mystic Woods, entreprise enregistrée en Finlande sous le numéro Y-Tunnus 3228464-2, dont le siège social est situé Korkeentie 37, 74670 Rapakkojoki, Finlande, représentée par Mme Lila PRATT, ci-après dénommée le VENDEUR ;
Et toute personne physique ou morale, ci-après dénommée le CLIENT, souhaitant procéder à un achat de PRODUITS proposés via le site internet www.lilamysticwoods.com ou via les réseaux associés, ci-après dénommé le SITE.
Ces CGV définissent les relations contractuelles entre le VENDEUR et le CLIENT, ainsi que les conditions applicables à tout achat effectué via le SITE, qu’il soit réalisé par un consommateur ou un professionnel.
Toute commande implique l’acceptation sans réserve des présentes CGV, dont le CLIENT reconnaît avoir pris connaissance au moment de la commande.
Le VENDEUR se réserve le droit de modifier ces CGV à tout moment et sans préavis. Les conditions applicables seront celles en vigueur à la date de la commande.
2. Produits
Les PRODUITS proposés sont pour la majorité des créations artisanales, réalisées à la main à partir de matériaux naturels tels que le bois ou les minéraux. Chaque pièce est unique, et peut donc présenter des différences par rapport aux photographies présentées. Ces dernières sont non contractuelles et à visée illustrative. Les accessoires présents sur les photos ne sont pas vendus avec le PRODUIT, sauf mention contraire.
Les produits sont proposés dans la limite des stocks disponibles. Certains produits étant personnalisables, un délai de fabrication pouvant aller de 15 à 40 jours peut être requis.
En cas de double commande d’un produit unique (avant mise à jour du stock), la commande validée sera celle enregistrée en premier, selon la date et l’heure. Le second CLIENT sera informé, et se verra proposer un remboursement ou un produit équivalent à fabriquer dans les délais indiqués.
3. Tarifs
Les prix sont indiqués en euros TTC. Sauf mention contraire, les frais de livraison ne sont pas inclus dans les prix affichés et sont précisés au moment de la validation de commande.
Le VENDEUR se réserve le droit de modifier ses prix à tout moment. Le prix applicable reste toutefois celui indiqué sur le SITE au moment de la commande.
4. Commandes, rétractation et retours
Toute commande est considérée comme irrévocable sauf dans le cadre du droit de rétractation prévu par le Code de la consommation français (pour les clients français) ou le Consumer Protection Act finlandais (pour les clients finlandais), à savoir un délai de 14 jours suivant la réception du produit.
Le droit de rétractation ne s’applique pas aux produits personnalisés ou réalisés sur commande, conformément à l’article L. 221-28 du Code de la consommation et à la directive européenne 2011/83/UE. Ces articles ne sont ni repris, ni échangés, ni remboursés.
En cas de rétractation valable, le remboursement sera effectué dans un délai de 14 jours à compter de la réception de la demande, par le même moyen de paiement que celui utilisé. Le remboursement peut être différé jusqu’à réception de la preuve de réexpédition.
Les frais de retour sont à la charge du CLIENT. Les articles doivent être renvoyés intacts, complets, si possible dans leur emballage d’origine, et dans les 14 jours suivant la notification de rétractation. Toute manipulation excessive du produit engage la responsabilité du CLIENT.
La vente est destinée aux CLIENTS résidant en Union Européenne, Suisse et Royaume-Uni. Des frais supplémentaires peuvent s’appliquer selon la destination.
Si un paiement n’est pas reçu dans les 14 jours suivant la commande, celle-ci sera automatiquement annulée.
5. Modalités de paiement
Le paiement s’effectue à la commande, par :
Paypal (compte requis)
Virement bancaire (coordonnées fournies à la finalisation)
Pour les paiements lors d’une remise en main propre, le CLIENT doit contacter le VENDEUR au préalable pour accord.
6. Livraison
Les produits sont expédiés en colis suivi ou lettre suivie selon leur taille. Le VENDEUR transmettra un numéro de suivi si disponible. Le suivi n’est pas garanti pour les petits articles envoyés en format lettre.
Le CLIENT est responsable de l’exactitude de l’adresse fournie. En cas d’erreur, les frais de réexpédition seront à sa charge.
Les colis sont préparés avec soin, mais le VENDEUR ne peut être tenu responsable des dommages, pertes ou vols survenus durant le transport. En cas de problème confirmé par le suivi (colis non livré), un remplacement ou un remboursement sera proposé, selon la disponibilité du produit.
Aucun remboursement ne sera effectué si le suivi indique que le colis a été livré.
7. Délais de livraison
Sauf mention contraire, l’expédition est généralement effectuée sous 15 jours après réception du paiement. Ce délai peut varier pour les créations personnalisées, auquel cas le CLIENT sera informé.
8. Garantie
En cas de non-conformité, le CLIENT peut retourner le produit après accord préalable. Le VENDEUR pourra proposer un échange, une réparation ou un remboursement.
Le CLIENT est responsable de l’usage du produit. Le VENDEUR ne peut être tenu pour responsable de dommages liés à un usage inapproprié, ni en cas de force majeure (grève, catastrophe naturelle, interruption des services de livraison, etc.).
9. Données personnelles
Les données personnelles collectées sont nécessaires à la gestion des commandes. Elles ne sont transmises qu’aux prestataires intervenant dans le traitement (livraison, paiement).
Conformément au RGPD, tout CLIENT dispose d’un droit d’accès, de rectification, de suppression ou d’opposition en écrivant à :

10. Litiges
En cas de litige, le CLIENT et le VENDEUR s’engagent à rechercher une solution amiable avant toute action judiciaire.
À défaut de résolution amiable, le tribunal compétent sera celui de Kuopio (Finlande), sauf disposition impérative contraire applicable au CLIENT consommateur.
Terms and Conditions of Sale
1. General Provisions
These terms and conditions of sale are concluded between:
LILA MYSTIC WOODS, hereinafter referred to as the « SELLER », a micro-enterprise registered in Finland under business ID (Y-tunnus) 3228464-2, with its registered office at Korkeentie 37, 74670 Rapakkojoki, Finland. Email: contact@lilamysticwoods.com.
And any individual or legal entity, hereinafter referred to as the « CLIENT », wishing to make a purchase of « PRODUCTS » through the website www.lilamysticwoods.com or associated official social media profiles, hereinafter referred to as the « SITE ».
These general terms and conditions aim to define the contractual relationship between the SELLER and the CLIENT and the conditions applicable to any purchase made via the SITE, whether the CLIENT is a professional or a consumer. Placing an order implies the CLIENT’s unreserved acceptance of these terms and conditions.
The SELLER reserves the right to modify these terms and conditions at any time without prior notice. However, such modifications will only apply to orders placed after their publication on the SITE.
2. Products
The PRODUCTS offered by the SELLER are handcrafted creations made from raw natural materials such as wood and minerals. Each item is unique; therefore, the product received may slightly differ from the photograph displayed on the SITE. Photographs are non-contractual and serve as presentation suggestions. Elements shown in the photographs other than the described item are for decorative purposes and are not included with the PRODUCT.
Each item is offered subject to availability. Information on product availability is provided in each description. Given their customizable nature, most products are made to order and require a manufacturing period ranging from fifteen (15) to forty (40) days per product.
In the event of an order for a unique PRODUCT that has already been sold—due to a technical issue where two orders are placed simultaneously before stock updates—the first order, determined by date and time, will be honored. The second CLIENT will be offered a refund or a similar product to be crafted within the aforementioned timeframe.
3. Pricing
Prices displayed on the SITE are in euros, inclusive of all taxes. They do not include shipping fees, which are charged additionally and indicated during the order finalization. The SELLER reserves the right to modify prices at any time, particularly due to supplier price changes. However, the price listed on the SITE at the time of the order will be the only one applicable to the CLIENT.
4. Orders, Withdrawal, and Returns
All orders are final for the CLIENT, subject to the legal right of withdrawal of 14 calendar days following the delivery date, in accordance with the Finnish Consumer Protection Act and EU Directive 2011/83/EU. The CLIENT has this period to return any item that does not meet their expectations and request an exchange or refund without penalty, except for return shipping costs, which are the CLIENT’s responsibility.
For custom-made items with options selected by the CLIENT, the right of withdrawal does not apply, as per Article 16(c) of Directive 2011/83/EU and corresponding Finnish legislation. Personalized items made to order will not be exchanged, returned, or refunded.
Refunds will be processed within 14 days following receipt of the withdrawal form, using the same payment method employed by the CLIENT, unless otherwise agreed. The refund may be deferred until the SELLER receives proof of return shipment, such as a tracking number.
Return shipping costs are borne by the CLIENT, and items must be returned in similar packaging conditions as initially used by the SELLER. Products must be complete and intact, preferably in their original packaging. The CLIENT agrees to return the products no later than 14 days after communicating their decision to withdraw, unless the SELLER offers to collect the goods.
The CLIENT may test the product but will be liable for any depreciation resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
By confirming the order, the CLIENT accepts all these terms and conditions and acknowledges full awareness thereof, waiving the right to invoke their own purchase conditions or other terms.
Online sales of the SELLER’s PRODUCTS are intended for CLIENTS residing in the European Union, Switzerland, and the United Kingdom. Additional shipping fees may apply depending on the destination.
If payment is not received within two (2) weeks following the order placement, the order will be considered null and automatically canceled.
5. Payment Methods
Payment for purchases is due upon order finalization. Payments can be made via:
PayPal: An immediate and secure electronic payment interface. The CLIENT must have a PayPal account to complete the purchase. For more information, visit www.paypal.com.
Bank Transfer: Payment details will be provided to the CLIENT during order finalization.
For payments upon personal delivery, the SELLER must be contacted, and approval must be obtained before placing the order.
6. Delivery
The standard national and international shipping method is tracked parcel or letter, depending on the size and weight of the items. An additional cost applies for express shipping. The SELLER commits to providing the CLIENT with the tracking number promptly. Note that tracking may not be available for letter-format shipments.
Additional fees may apply for shipments outside the European Union. For any such orders, the CLIENT must inform the SELLER in advance.
The parcel is shipped at the CLIENT’s risk. The SELLER ensures proper packaging to minimize damage during transport but cannot be held responsible for any damage occurring after the parcel is handed over to the postal service.
Unless otherwise specified, delivery is made to the address provided by the CLIENT during the order process. In case of an error in the recipient’s address details, the SELLER cannot be held responsible for the inability to deliver the product. Additional costs related to reshipment due to returned parcels are the CLIENT’s responsibility.
The SELLER will inform the CLIENT about the manufacturing and delivery details once the order is finalized and payment is received.
In case of damage during transport, a claim must be filed with the carrier upon receipt. The SELLER is not liable for any damage, loss, or theft of parcels by the carrier. Tracked shipping allows monitoring of the parcel during transit.
If a delivery issue arises, such as loss or theft, a new parcel will be sent to the CLIENT if the items are still available, or a refund will be issued for unique or non-reproducible items. No parcel will be resent or refunded if the tracking system indicates that the parcel has been delivered to the recipient.
7. Delivery Times
Unless otherwise stated (e.g., specific email to the CLIENT or absence notice on the SITE), shipments are generally made within fifteen (15) days from receipt of payment and order validation, depending on product availability and manufacturing time. Some items (large formats or personalized orders) may require a longer production period. In such cases, the CLIENT will be duly informed.
8. Product Warranty and Services
In case of non-conformity of a sold product, it can be returned to the SELLER, who will accept it back, exchange it, or refund it as per the agreement between the SELLER and the CLIENT. The CLIENT is solely responsible for the choice of products, their storage, and use. The SELLER cannot be held liable for any damages resulting from improper use of the products.
The SELLER will not be considered responsible for delays or failures due to force majeure events recognized under Finnish law (e.g., product unavailability, total or partial strikes, postal service disruptions, floods, fires).
9. Personal Data Protection
The SELLER reserves the right to collect personal information necessary for managing the CLIENT’s order.
This information may be shared with companies involved in order execution, such as those handling services, orders, processing, and payment.
Data is also retained for security purposes and to comply with legal and regulatory obligations.
In accordance with the General Data Protection Regulation (GDPR), the CLIENT has the right to access, rectify, and oppose personal data concerning them by contacting the SELLER.
10. Disputes
In the event of disputes related to these general terms and conditions and the resulting sales operations, the SELLER and the CLIENT agree to seek an amicable resolution before initiating any legal proceedings.
All disputes arising from these terms and conditions and the related sales operations, concerning their validity, interpretation, execution, termination, consequences, and aftermath, will be submitted to the competent court in Kuopio, Finland.
