EXPOSÉ PRÉALABLE

Les présentes Conditions Générales d’Utilisation (ci-après les « CGU ») régissent les modalités d’accès et d’utilisation du site internet www.lilamysticwoods.com (ci-après le « Site »), proposé par l’entreprise individuelle  Lila Mystic Woods.

Les services du Site ne peuvent être utilisés que par une personne juridiquement capable, c’est-à-dire une personne majeure ou un mineur émancipé. En accédant au Site et en utilisant ses services, l’Utilisateur reconnaît avoir cette capacité, accepte d’être lié sans restriction ni réserve par les présentes CGU, et déclare en avoir pris connaissance dans leur intégralité.

Les présentes CGU sont accessibles en permanence dans le pied de page du Site. Elles peuvent être modifiées à tout moment par la micro-entreprise Lila Mystic Woods. Toutefois, seules les CGU en vigueur au moment de l’utilisation du Site sont applicables.

ARTICLE 1 – Définitions

Dans les présentes CGU, les termes suivants sont définis comme suit :

  • « Site » : l’ensemble des pages web accessibles à partir de l’adresse www.lilamysticwoods.com.

  • « Utilisateur(s) » : toute personne physique ou morale accédant au Site.

  • « Partenaire(s) » : les personnes ou entités dont les services ou produits sont présentés sur le Site.

  • « Données à caractère personnel » : toute information se rapportant à une personne physique identifiée ou identifiable, selon l’article 4 du RGPD.

  • « Données » : toutes informations fournies par un Utilisateur pour contacter la micro-entreprise.

  • « Métadonnées » : données techniques issues de la navigation d’un Utilisateur sur le Site (adresse IP, type d’appareil, etc.).

ARTICLE 2 – Objet

Les présentes CGU n’ont pas pour effet de créer une relation de partenariat, d’association, d’emploi ou de représentation entre l’Utilisateur et la micro-entreprise Lila Mystic Woods.

Le Site a un rôle de vitrine et propose un formulaire de contact permettant aux Utilisateurs d’entrer en relation avec la société, notamment pour des prestations juridiques. Le présent Exposé Préalable fait partie intégrante des CGU.

ARTICLE 3 – Propriété intellectuelle

Le contenu du Site, y compris les textes, images, graphismes, logos, vidéos et éléments sonores, est la propriété exclusive de Lila Mystic Woods ou de ses Partenaires, et est protégé par les lois nationales et internationales en matière de propriété intellectuelle. Toute reproduction, totale ou partielle, sans autorisation écrite, est strictement interdite.

ARTICLE 4 – Marques déposées

Les marques, logos, graphismes, en-têtes, icônes et scripts utilisés sur le Site, qu’ils soient déposés ou non, sont la propriété exclusive de Lila Mystic Woods, sauf mention contraire. Toute utilisation non autorisée est interdite, notamment si elle est susceptible d’induire en erreur ou de nuire à l’image de la société.

Les marques de tiers apparaissant sur le Site sont la propriété de leurs détenteurs respectifs.

ARTICLE 5 – Données et vie privée

Depuis le 25 mai 2018, le Site est conforme au Règlement Général sur la Protection des Données (RGPD – Règlement UE 2016/679).

Article 5.1 – Collecte des Données

La collecte de données respecte les principes du RGPD :

  • Licéité, loyauté, transparence : collecte uniquement avec le consentement explicite de l’Utilisateur, avec mention de la finalité.

  • Finalité limitée : collecte uniquement pour les objectifs déterminés dans les CGU.

  • Minimisation des données : seules les données strictement nécessaires sont collectées.

  • Conservation limitée : les données sont conservées un an, sauf demande de suppression anticipée.

  • Intégrité et confidentialité : mesures de sécurité adaptées.

Les données peuvent être collectées via :

  • Le formulaire de contact ;

  • L’utilisation de cookies lors de la navigation (sous réserve de consentement).

Article 5.2 – Utilisation des Données

Les données collectées sont utilisées pour :

  • Répondre aux demandes et proposer des services adaptés ;

  • Analyser l’utilisation du Site afin d’améliorer ses performances.

Article 5.3 – Conservation

Les données sont conservées un an à compter de leur collecte, sauf demande de suppression par l’Utilisateur. Si la durée exacte ne peut être déterminée, des critères transparents seront communiqués à l’Utilisateur.

Article 5.4 – Droits de l’Utilisateur

L’Utilisateur dispose des droits suivants :

  • Accès, rectification, suppression ;

  • Portabilité vers un autre fournisseur ;

  • Limitation et opposition au traitement ;

  • Détermination du sort des données après la mort ;

  • Réclamation auprès de la CNIL ou d’un juge compétent.

Article 5.5 – Cookies

Le Site utilise des cookies :

  • Techniques : pour le bon fonctionnement ;

  • De performance : pour analyser l’usage du Site ;

  • De tiers (ex. : Google Analytics, réseaux sociaux).

Le consentement est valable pour 13 mois maximum. L’Utilisateur peut refuser ou supprimer les cookies via les paramètres de son navigateur. Toutefois, certaines fonctionnalités du Site pourraient en être affectées.

ARTICLE 6 – Responsabilité

Article 6.1 – Responsabilité de la Société

Lila Mystic Woods s’engage à maintenir un accès raisonnable au Site. Elle ne saurait être tenue responsable :

  • Des interruptions liées à la maintenance ou à des événements extérieurs (force majeure) ;

  • De tout dommage indirect ou imprévisible (perte de données, revenus, etc.).

Des limitations peuvent ne pas s’appliquer dans certains pays, selon la législation locale.

Article 6.2 – Traitement des Données

Le Responsable du traitement s’engage à :

  • Ne pas transmettre les données sans information préalable ;

  • Respecter la finalité du traitement ;

  • Informer l’Utilisateur en cas de violation de sécurité.

Article 6.3 – Responsabilité des Utilisateurs

L’Utilisateur s’engage à :

  • Ne pas usurper d’identité ;

  • Ne pas diffuser de contenu illicite ou nuisible ;

  • Ne pas porter atteinte au fonctionnement ou à la sécurité du Site ;

  • Respecter les droits de propriété intellectuelle.

ARTICLE 7 – Sites tiers

Le Site peut contenir des liens vers des sites tiers. Lila Mystic Woods décline toute responsabilité quant au contenu ou au fonctionnement de ces sites externes.

ARTICLE 8 – Droit applicable et langue

Les présentes CGU sont régies par le droit finlandais. La langue de référence est le français. En cas de contradiction avec une traduction, seul le texte français fera foi.

ARTICLE 9 – Litiges

Tout litige relatif à l’interprétation, l’exécution ou la validité des présentes CGU sera soumis aux tribunaux compétents selon le droit commun. En cas de litige avec un professionnel ou commerçant, les tribunaux de Kuopio (Finlande) seront compétents.

These General Terms of Use describe the conditions under which the Micro-Enterprise Lila Mystic Woods provides access to and use of its website www.lilamysticwoods.com (hereinafter referred to as « the Site »).

The services offered on the Site may only be used by a legally competent person, meaning an adult or an emancipated minor. By agreeing to use all or part of the services provided by Lila Mystic Woods on the Site, the User acknowledges being legally competent, agrees to be bound by these general terms without restriction or reservation, and acknowledges having read them in their entirety.

These General Terms of Use are accessible via every footer of the Site. They may be modified at any time by Micro-Enterprise Lila Mystic Woods. However, Users are only bound by the version of the Terms in effect at the time of their visit. The Terms enter into force upon their publication on the Site.

ARTICLE 1 – Definitions

In these General Terms of Use, the following terms shall have the meaning indicated:

  • « Site »: designates all pages of the website and the services accessible via the address www.lilamysticwoods.com.

  • « User(s) »: designates any natural or legal persons accessing the Site;

  • « Partner(s) »: designates persons whose services or products are highlighted on the Site;

  • « Personal Data »: means any information relating to an identified or identifiable natural person (hereinafter referred to as « data subject »), as defined in Article 4 of the GDPR; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity;

  • « Data »: means any information provided by a User to contact the Company;

  • « Metadata »: means all information the Site may collect from Users’ browsing activity.

ARTICLE 2 – Purpose

These General Terms of Use do not create any relationship of partnership, collaboration, employment, or other between the User and Micro-Enterprise Lila Mystic Woods. The User is not authorized to act as a representative of the Company.

The Site provides a contact form allowing Users to contact the Company to propose legal services. The Site may also be consulted as a showcase website. All elements displayed on the Site must be respected as outlined here.

The Prior Statement forms an integral part of these General Terms of Use.

ARTICLE 3 – Intellectual Property

The content of the Site is the exclusive property of Micro-Enterprise Lila Mystic Woods and its Partners and is protected by French and international laws relating to intellectual property. Any full or partial reproduction of this content is strictly prohibited and may constitute an infringement offense.

ARTICLE 4 – Registered Trademarks

A non-exhaustive list of trademarks registered by Micro-Enterprise Lila Mystic Woods, as well as graphics, logos, headers, buttons, scripts, and other graphic elements representing the Company appear on this Site.

The trademarks and visuals of the Company may not be used for products or services that do not belong to it, or in any manner that could cause confusion among clients, or in any manner that disparages or discredits it.

All other trademarks appearing on the Site belong to their respective owners, who may or may not be affiliated, connected, or sponsored by the Company.

ARTICLE 5 – Data and Privacy

Since May 25, 2018, this Site complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

Article 5.1 – Data Collection

In accordance with Article 5 of Regulation (EU) 2016/679, the collection and processing of User Data on the Site comply with the following principles:

  • Lawfulness, fairness, and transparency: data may only be collected and processed with the consent of the data owner. Whenever personal data are collected, the User will be informed of the data collected and the reasons for collection;

  • Purpose limitation: data collection and processing are carried out to achieve one or more purposes defined in these Terms;

  • Data minimization: only data necessary for the purposes pursued by the Site are collected;

  • Storage limitation: data are kept for a limited period, of which the User is informed. If the retention period cannot be specified, the User is informed of the criteria used to determine it;

  • Integrity and confidentiality: the data controller undertakes to guarantee the integrity and confidentiality of the data collected.

Data collection and processing are lawful only if at least one of the conditions listed in Article 6 of Regulation (EU) 2016/679 is met, including User consent, contract performance, legal obligation, vital interests, public interest, or legitimate interests pursued by the controller.

Browsing the Site can be done anonymously. Data collected include electronic correspondence, letters, and any documents transmitted by the User. Metadata such as IP address, connection type, browsing data, and page statistics are also collected when the User consents to cookies or submits the contact form.

Article 5.2 – Use of Data

Collected Data will be used for:

  • Providing the services offered on the Site, including responding to any User requests;

  • Analyzing trends, usage, and User behavior to adapt and improve the Site’s usability.

Article 5.3 – Data Management

The data controller will keep collected data securely for one year unless the User requests deletion earlier. Users will be informed of data retention durations or criteria.

Article 5.4 – User Rights

Under applicable data protection laws, Users have the following rights:

  • Right of access, rectification, and erasure;

  • Right to data portability;

  • Right to restrict or object to data processing;

  • Right to decide the fate of data after death, per applicable law;

  • Right to lodge a complaint with the supervisory authority (CNIL) or competent court if requests are refused.

Users must provide their name and email to exercise these rights. The data controller will respond within 30 days.

Article 5.5 – Cookies

To improve service, Users may receive cookies—small files stored on devices identifying the device and personalizing the experience. Cookies include performance cookies analyzing interactions with the Site.

Cookies require User consent for storing or analyzing personal data. Consent lasts for the session and up to thirteen months maximum, after which consent must be renewed.

Users can disable cookies via their browser, but this may affect Site functionality. Third-party cookies (e.g., Google Analytics, social media sharing buttons) may be stored, and Users should consult respective privacy policies.

ARTICLE 6 – Liability

Article 6.1 – Liability of the Company

Micro-Enterprise Lila Mystic Woods strives to ensure Site availability but may suspend access temporarily for maintenance or updates.

The Company is only liable for damages caused by its own fault. It shall not be liable for indirect or unforeseeable damages, loss of revenue, data, customers, or expenses.

The Company is not liable for delays or failures beyond its reasonable control.

Some jurisdictions do not allow limitation of liability as described; in such cases, Users retain applicable rights.

Article 6.2 – Data Controller Obligations

The data controller commits to protecting personal data, not sharing it with third parties without notice, respecting collection purposes, notifying Users of corrections or deletions unless disproportionate, and informing Users in case of data breach.

Article 6.3 – User Obligations

Users must comply with laws when interacting with the Site and must not:

  • Impersonate any person or entity;

  • Transmit illegal, abusive, defamatory, threatening, obscene, or privacy-invading content;

  • Attempt unauthorized modification or disruption of the Site or its security;

  • Post content infringing third-party intellectual property rights.

ARTICLE 7 – Third-Party Sites

The Site may contain links to third-party websites. Micro-Enterprise Lila Mystic Woods does not control these and is not responsible for their content. Leaving the Site for third-party sites is at the User’s own risk.

ARTICLE 8 – Governing Law and Language

By express agreement, these General Terms of Use are governed by Finnish law and written in French. In case of translation, the French text prevails in case of dispute.

ARTICLE 9 – Disputes

Any disputes concerning validity, interpretation, execution, termination, or consequences of these Terms will be submitted to competent courts under common law. In disputes involving professionals or merchants, courts in Kuopio (Finland) shall have jurisdiction.
